The Supreme Court has finally put an end to the tragic accident case

The initial proceedings in the case resulted in an acquittal from the First Instance Court. This judgment was subsequently reviewed by the Court of Appeal, which upheld the initial ruling without specifying whether the convicted individual or his surviving spouse was operating the vehicle at the time of the incident. Upon returning the matter for re-examination on appeal, the Court of Appeal issued specific directives.

It stipulated that in determining the driver, the court must weigh several factors: the testimony provided by court experts, the consistency of the expert report with the totality of the evidence presented, the documented injuries sustained by the deceased, and the accounts given by the witnesses. Following this re-evaluation, the appellate body issued a revised indictment. This new ruling established that the convicted person was the driver of the vehicle.

Consequently, the individual was sentenced to five years of imprisonment. Furthermore, the court addressed the associated civil claims filed by the victims and other claimants, determining that these claims were only partially satisfied. The overall case involved multiple civil claims from various parties, which formed part of the legal proceedings reviewed through the appeal process.
