The court of appeal will announce the decision in R. Žemaitaičio case in July

Following a judgment rendered by the Vilnius District Court on December 4, 2019, the legal proceedings have been challenged through an official appeal. The appeal was filed by multiple parties, including R. Žemaitaitis, his legal representative Vytautas Sirvydis, and the state prosecutor’s office.

The appeals present divergent objectives regarding the outcome of the case. R. Žemaitaitis and his lawyer are jointly advocating for the complete acquittal of the leader associated with the “Aušra” movement.

In contrast, the prosecutor’s office has presented a distinct set of demands to the higher court. Specifically, the prosecutor has requested a significant increase in the financial penalty, seeking a fine amount exceeding ten times the original sum, citing a figure of €51,250. Furthermore, the prosecutor is appealing to have annulled a specific section of the original court ruling.

This section pertains to the removal of the charge concerning the denial of the genocide committed against the Jewish nation during the Holocaust. The filing of these appeals indicates a significant divergence in legal strategy among the involved parties. The court is now tasked with reviewing the grounds for the appeal and weighing the conflicting requests regarding both the criminal charges and the prescribed penalties.
